This website is operated by Bloominous, Inc. Throughout the site, the terms “we”, “us”, “our” and "Bloominous" refer to Bloominous Inc. We offer this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

1. Online Store Terms

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

2. General Conditions

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

3. Order Changes / Cancellations

Bloominous allows for orders changes and cancellations 30 days prior to scheduled delivery date. There is a 3% restocking and bank service fee for any refunds. If you wish to change or cancel your order, please call us at 310-873-3137 or email us at support@bloominous.com.

4. Problems With Your Order

If you are not satisfied with the quality of our flowers, please call us at 213-296-1883 or email us at support@bloominous.com with your order number and the problem you are trying to resolve.

It's important that you contact us within 24 hours of your delivery so we can rectify the situation - either by replacing the product in time for your event or issuing a refund. NO REFUNDS WILL BE ISSUED OUTSIDE THIS POLICY.

We may ask that you send us a photo of the flowers that are not to your satisfaction so we can examine the underlying issue. Our team of flower experts can see if it's just an issue with the flowers being "young" and will take another day to open, or truly flowers that need to be replaced or refunded.

5. Shipping & Delivery

We have put a lot of thought into packaging our kits and shipping them fast so you get the best quality flowers. We work with our shipping partners at FedEx to make this happen, but there are times that they cannot fulfill their terms of service to us due to nature or mechanical issues with their planes. In these cases, we will look for additional solutions to get your package to you, but that is a risk that we have to honestly say we may not be able to mitigate.

We will provide you with your tracking number once the package is inside the FedEx system. It is recommended that someone be available to receive the package so it does not sit outside under sunlight or is lost or stolen.

Replacement & Refund

If you are not satisfied with the quality of our flowers, please call us at 213-296-1883 or email us at support@bloominous.com with your order number and the problem you are seeing.

1. Replacements

We take a lot of care to source and package the best flowers in the world for you. In the unlikely event your flowers are below our quality standards, we will overnight a replacement for you at no extra cost. Please contact us at 213-296-1883 or email us at support@bloominous.com within 24 hours of delivery.

2. Refund

To be eligible for a refund, your unused flowers and vases must be returned and in the same condition that you received it. It must be postmarked before your wedding in order to be eligible.

To return your product, you should mail your product to:

Your total refund will be the market value of the stems you send back to us and the price of the vases net deductions. If extra complimentary flowers were sent to you, those are not eligible for a refund.

3. Deduction

• Shipping charges are not refundable. If shipping was waived, actual costs will be deducted from your refund.

• You will be responsible for the cost of shipping the items to us. If more convenient, we can send a return label for you.

• There is a 5% deduction for restocking and bank fees on all refunds

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment.

4. Late or Missing Refund

It may take up to 2 weeks for your refund to be posted depending on your payment processor.

Check with your bank or credit card company to see if there are any pending transactions, then contact us at support@bloominous.com for further support.
